How do arts organizations comply with the Unsolicited Electronic Messages Act?

I am worried about the Unsolicited Electronic Messages Act – can you explain in an ‘arts-friendly’ way what we need to do to stay within the law? One of our board members has been asking me about it and I’m not feeling as confident as I should.

I find the Unsolicited Electronic Messages Act quite simple to understand and comply with. It is definitely something to be respected rather than feared, as the principles to me are basic common sense. If you care about your audience members and appreciate the fact they have shared their email addresses with you, then you wouldn’t want to be managing things any other way.

The key things to remember are:

-    Be very clear about what you are asking people to sign up for and give them a sample, if possible, of what they are going to receive, e.g. http://www.the-edge.co.nz/signup.aspx

-    Do not use their email address for any other promotional purpose

-    Keep their email address secure and never pass it to a third party without the owner’s permission

-    Identify yourself clearly when sending email to them

-    Provide an easy and clear opt-out method and follow up on any opt-out request quickly.
